Welcome to SuSastho, a digital health platform developed and managed by CMED Health Ltd ("CMED Health", "we", "us", or "our").

Please read these Terms & Conditions ("Terms") carefully. By accessing, downloading, or using the SuSastho mobile or web application (the "App" or "Services"), you agree to be bound by these Terms. If you do not agree with any part of these Terms, you must immediately discontinue your use of the Services. If you are accepting these Terms on behalf of another individual, you represent that you have the legal authority to do so.

1. Description of Services

SuSastho provides a comprehensive suite of digital health services, which includes but is not limited to:

  • Creation, maintenance and management of a digital health account.
  • Primary health screening and monitoring.
  • Telemedicine (Audio & Video) consultations with BMDC certified physicians.
  • Secure health record storage.
  • Any other health related services.

Disclaimer:

  • Registered Doctors will only be able to give you first-aid solution, guidance, and counselling prior to the in-person interaction and refer the Patient to in-person care. In the event that you rely on the Services provided by SuSastho to address an emergency situation, SuSastho or the Doctor shall not be liable for any loss and damages, including loss of life or limb, caused by such reliance.
  • While SuSastho facilitates access to health professionals and health data tracking, the App itself does not replace professional medical advice, diagnosis, or treatment for severe or life-threatening conditions. In the event of a medical emergency, please contact your local emergency services immediately.
  • By seeking Telemedicine consultation using SuSastho, you consent to the delivery of medical services by the Physicians using Telemedicine facilities and agree that the Doctors would have access to your phone number, stored medical records, and allow them to call you back if there is a communication issue or to follow-up.

2. User Account Creation and Customer Registration

To access our Services, you must register and create an account, which generates a unique system-generated User ID. By registering, you agree to the following:

  • Accuracy of Information: You warrant that all information provided during registration (including name, contact details, identification, and demographic data) is true, accurate, current, and complete. You agree to promptly update your information as necessary.
  • Account Security: User Account is secured by unique User ID and password. You are solely responsible for maintaining the confidentiality of your login credentials and password. You are responsible for all activities that occur under your account. If you suspect unauthorized access, you must notify us immediately.

3. Privacy and Data Protection

Your privacy is a priority to us. Our collection, use, and sharing of your personal and health information are strictly governed by our Privacy Policy.

  • Data Security: We align with GDPR and HIPAA standards and utilize secure servers managed by DigitalOcean, LLC.
  • Consent: By using the Services, you consent to the collection and processing of your data as outlined in the Privacy Policy, including necessary permissions (e.g., location, internet, bluetooth) required for the App to function properly.

4. Acceptable Use and User Conduct

You agree to use the SuSastho App only for its intended, lawful purposes. You shall not:

  • Submit false, fraudulent, or misleading information.
  • Use the App to distribute malware, viruses, or any other harmful software.
  • Attempt to gain unauthorized access to our servers, audit logs, or other users' accounts.
  • Use the Services in a manner that disrupts, disables, or overburdens the App's infrastructure.
  • Reproduce, duplicate, copy, sell, or exploit any portion of the Services without express written permission from CMED Health Ltd.

5. Intellectual Property Rights

All content, features, algorithms, branding, and functionality within the SuSastho App (excluding your personal health data) are the exclusive property of CMED Health Ltd and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes

6. Limitation of Liability

To the maximum extent permitted by applicable law, CMED Health Ltd, its employees, authorized agents, and service providers shall not be liable for:

  • Any indirect, incidental, special, or consequential damages arising out of or in connection with your use or inability to use the Services.
  • The actions, advice, or medical interventions provided by independent healthcare professionals accessed through the telemedicine feature.
  • Any unauthorized access to your account resulting from your failure to safeguard your login credentials.

7. Modifications to the Service and Terms

We reserve the right to modify, suspend, or discontinue any part of the Services at any time without prior notice. We may also revise these Terms periodically. Continued use of the App following any updates constitutes your acceptance of the revised Terms.

8. Account Cancellation and Termination

  • By User: You have the right to cancel your registration at any time by sending a request to info@cmedhealth.com. Upon cancellation, your data will be retained or purged in accordance with our data retention policies and applicable laws.
  • By CMED Health: We reserve the right to suspend or terminate your access to the App immediately, without prior notice, if you breach any provision of these Terms or engage in illegal or fraudulent use of the Services or, are inactive for a period of 12 months or more.

9. Grievance Handling and Dispute Resolution

  1. If you have any questions, concerns, or grievances regarding these Terms, our security practices, or your account, please contact our Grievance Redress focal point:

  2. SuSastho encourages amicable settlement of any conflict/s that might arise among you, SuSastho or any other user/service provider(s) including the Registered Doctors. For addressing any grievances, or any other issues, transaction disputes you are encouraged to report the same to info@cmedhealth.com with a subject line “Dispute Notice”. On service of the Dispute Notice, SuSastho and you will attempt in good faith for an amicable resolution to the dispute. .
  3. If the dispute cannot be resolved by mutual discussion within 28 (twenty-eight) working days from the date of commencement of such consultation, the matter shall be referred for arbitration and settled in accordance with the Arbitration Act, 2001. The decision of the arbitrator will be final and binding upon the Parties. Each Party shall bear their costs of arbitration. The venue for arbitration shall be Dhaka and the proceedings of arbitration shall be held in the English language.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Government of Bangladesh. Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the competent courts in Bangladesh.
